ISSS will only prepare H-1B applications for medical residents/fellows who have obtained prior approval from the Graduate Medical Education office. The hiring department must provide copies of the approved H-1B Visa Request Form and supporting documents to ISSS when initiating the H-1B request.
Documentation of Work Locations
H-1B regulations require employers to list the physical work locations on the Labor Condition Application (LCA) and the H-1B petition, and to notify its workforce of its intention to hire an H-1B employee. ISSS will send a Notice to Employees that must be posted for 10 days at each of the physical work locations.
Consequently, for any location (hospital or clinic or office) where a resident/fellow will work for more than 10 consecutive days or more than 30 days in a year, the hiring department must supply ISSS with the following information about each location. ISSS will provide a template to gather the following information:
- Name of work site
- Complete address (including street and #, city, state, zip code)
- Administrative contact person (name, phone, email)
Start H-1B requests early! Because of extensive documentation required for H-1B petitions for medical resident/fellow cases (USMLE 1, 2 & 3, Minnesota licensure, multiple work locations), hiring departments must initiate H-1B requests by completing the Employee Intake Information questionnaire:
- No later than 3 months before the job start date for new H-1Bs (persons not already in H-1B status)
- No later than 2 months before the job start date for H-1B transfers and extensions
ISSS reserves the right to decline cases and refer departments to private attorneys if requests do not meet these deadlines.
